Terms & Conditions
These Terms & Conditions (“Agreement”) outline the responsibilities, expectations, and legal requirements between Lifeline Connections (“the Agency”), the client (“Client”), and the caregiver (“Caregiver”). By using our services, the Client agrees to the terms below.
1. Scope of Services
The Agency provides caregiver placement and support services for:
Childcare & Nanny Services
Special Needs Childcare
Senior & Elder Companion Care
Personal Care Aide Services
Homemaker Services (meal prep, light cleaning, errands)
Overnight Care
The Client acknowledges that services vary depending on whether the Caregiver is engaged under the Agency Pay W-2 model or the Client Pay 1099 model.
2. Payment Structure Options
A. Agency Pay (W-2 Employee Model)
Under this model:
Caregivers are employees of the Agency.
The Agency handles payroll, taxes, insurance, and workers’ compensation.
Clients pay the Agency directly for all booked hours, fees, and applicable charges.
The Agency oversees onboarding, training, documentation, and quality assurance.
B. Client Pay (1099 Independent Contractor Model)
Under this model:
Caregivers are independent contractors, not Agency employees.
Clients pay caregivers directly for hourly services.
Rates, schedules, responsibilities, and expectations are set between the Client and Caregiver.
Caregivers are responsible for their own tax reporting and income management.
The Agency’s role is limited to referral, matching, and introduction.
3. Fees & Charges
The Agency may charge:
Registration / sign-up fees
Background check fees
Agency administrative fees (if applicable under W-2 model)
Fees are non-refundable unless otherwise stated in writing.
4. Client Responsibilities
The Client agrees to:
Provide a safe working environment for all Caregivers
Accurately disclose household needs, health conditions, special requirements, or risks
Pay all fees, invoices, and charges in the manner required by the selected model
Communicate schedule changes, cancellations, or concerns in a timely manner
For 1099 Client Pay relationships, the Client is responsible for fulfilling all financial agreements made directly with the Caregiver.
5. Agency Responsibilities
The Agency agrees to:
Conduct background checks and screening to the best of its ability
Provide referrals and caregiver placements appropriate to the Client’s needs
Manage employment documentation for W-2 Caregivers
Provide replacement or assistance whenever possible (not guaranteed)
The Agency is not responsible for supervising 1099 Caregivers after placement.
6. Cancellations & Scheduling
Policies differ depending on payment model:
W-2 Caregivers: Clients must follow the Agency’s cancellation policy and minimum-hour requirements.
1099 Caregivers: Cancellations, minimum hours, and schedule adjustments are determined between Client and Caregiver.
7. Liability Waiver (Client Pay / 1099 Model)
By selecting the Client Pay option, the Client acknowledges and agrees that:
Caregivers are not Agency employees or representatives.
The Agency does not insure or supervise Caregivers under this model.
The Agency is not liable for any injuries, accidents, damages, losses, negligence, misconduct, theft, property incidents, or disputes.
The Client accepts full responsibility for the actions of the Caregiver during services.
The Client releases the Agency from all claims arising out of services performed by a 1099 Caregiver.
8. Safety & Conduct
Clients and Caregivers must maintain:
Respectful and safe working environments
Compliance with state and federal regulations
No harassment, abuse, or unsafe conditions
The Agency reserves the right to terminate services for unsafe or inappropriate behavior.
9. Confidentiality
All personal, household, and medical information provided to the Agency or Caregiver will remain confidential, except where disclosure is required by law.
10. Termination of Services
The Agency may discontinue services at any time for:
Non-payment
Safety concerns
Inaccurate or withheld information
Client misconduct
Violations of these Terms & Conditions
The Client may terminate services by notifying the Agency in accordance with its cancellation policy.
11. No Guarantee of Service
While the Agency strives to provide reliable, qualified Caregivers, availability is subject to:
Scheduling conflicts
Staff illness or emergencies
Local caregiver shortages
Holidays and high-demand periods
The Agency does not guarantee placement continuity, replacement, or long-term availability.
12. Agreement & Acceptance
By booking services, meeting with a Caregiver, or submitting payment or fees, the Client confirms that they:
Have read and understood these Terms & Conditions
Agree to abide by all policies
Acknowledge the differences between W-2 and 1099 models
Accept the Liability Waiver where applicable
These Terms & Conditions form the full agreement between the Client and the Agency.
